Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the AesteeAI mobile application (the "Service") operated by Volodymyr Yarema ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. The Service
AesteeAI provides an artificial intelligence-based service that allows users to generate unique images and videos ("Generated Content") based on templates and user-provided photographs ("User Content").
2. User Content
You are solely responsible for the User Content you submit. You retain all of your ownership rights in your User Content, but by submitting it to the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, and process that User Content for the sole purpose of operating and providing the Service to you.
You represent and warrant that you have the necessary rights to the User Content you submit and that your User Content does not violate any third-party rights, including copyright, trademark, or privacy rights. You agree not to submit any User Content that is illegal, obscene, defamatory, or otherwise objectionable.
3. Generated Content
We grant you a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, display, and distribute the Generated Content for any personal or commercial purpose.
4. Subscriptions and In-App Purchases
The Service operates on a system of in-app currency known as "Coins" and subscriptions.
5. Acceptable Use Policy
You agree not to use the Service to:
- Decompile, reverse engineer, or otherwise attempt to obtain the source code of the Service.
- Submit any User Content that is unlawful, harmful, or infringes on the rights of others.
- Interfere with or disrupt the integrity or performance of the Service or its servers.
6. Termination
We may terminate or suspend your access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
7. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We do not warrant that the results of using the service will meet your requirements, be uninterrupted, or be error-free. The quality of Generated Content may vary and may be unpredictable.
8. Limitation of Liability
In no event shall Volodymyr Yarema, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
9. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
